Agent Octane, Inc. (“we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains what data we collect, how we use it, and the choices you have.

1. What Data We Collect

We collect the following categories of information when you use Agent Octane:

Account Information

When you sign up, we collect your email address and any profile information you provide (name, brokerage, phone number, license number).

Transaction Data

Transaction details you enter into the platform — including property addresses, buyer/seller names, contact information, closing dates, deal values, and attached documents.

Usage Data

How you interact with the Service — pages visited, features used, actions taken, and session timestamps. This helps us understand what's working and what to improve.

Communications

Messages sent through the platform, AI chat history, and any content generated using our AI tools.

Payment Information

Billing details are handled entirely by Stripe. We never see or store your full credit card number. We only receive a payment confirmation and your subscription status from Stripe.

Voice Data

If you use VAPI-powered voice features, voice call metadata (call duration, outcomes) is logged. Audio recordings are processed by VAPI in accordance with their privacy policy and are not stored long-term by Agent Octane.

2. How We Use Your Data

We use the data we collect solely to operate and improve the Service:

  • Service delivery: Power your dashboard, transactions, AI employees, and automations.
  • Communications: Send you transactional emails (magic links, deal notifications, review requests).
  • AI personalization: Generate content (social posts, messages) personalized to your real deal data.
  • Support: Diagnose issues and respond to your support requests.
  • Product improvement: Analyze aggregate usage patterns (never individual client data) to improve features.
  • Billing: Process subscription payments and manage your account status.

3. What We Never Do

We take your trust seriously. Here's what we will never do:

  • Never sell your data. We do not sell, rent, or license your personal information or your clients' data to any third party — period.
  • Never share with third parties for marketing. Your data is never shared with advertisers, data brokers, or marketing platforms.
  • Never use client data for AI training without consent. We do not use your clients' personal information to train AI models.
  • Never access your account without cause. Our team does not access your transaction data or client information unless required to resolve a technical issue and with your permission.

4. Third-Party Service Providers

We work with a small number of trusted service providers to deliver the platform:

Resend (Email Delivery)

We use Resend to send transactional emails (magic links, deal notifications, review requests). Resend processes email addresses and content solely to deliver emails on our behalf. Resend Privacy Policy →

Stripe (Payments)

All payment processing is handled by Stripe. When you enter payment details, you're communicating directly with Stripe's secure systems — we never see your card number. Stripe Privacy Policy →

VAPI (Voice AI)

Voice AI features are powered by VAPI. Call metadata is processed by VAPI to handle routing and responses. VAPI Privacy Policy →

OpenAI (AI Content)

AI-generated content (social posts, chat responses) is processed by OpenAI. Prompts are generated using your data to personalize output; we send only what is necessary. We do not use the OpenAI API in a way that allows OpenAI to use your data for training by default.

We do not sell data to any of these providers. They are processors acting on our instructions.

5. Cookie Policy

Agent Octane uses cookies and similar technologies to maintain your session and improve performance. Specifically:

  • Session cookies: Required to keep you logged in. These expire when you close your browser or log out.
  • Preference cookies: Remember your settings and UI preferences.

We do not use third-party advertising or tracking cookies. We do not track you across other websites.

You can disable cookies in your browser settings, but this may affect your ability to use the Service.

6. Data Retention

We retain your account and transaction data for as long as your account is active. If you cancel, your data is retained for 30 days during which you can request an export. After that, it is permanently deleted from our systems.

Some anonymized aggregate data (e.g., total number of deals processed across the platform) may be retained indefinitely for business analytics purposes — but this cannot be linked back to you or your clients.

7. Your Rights

You have the right to:

  • Access the personal data we hold about you.
  • Correct inaccurate information in your account.
  • Export your transaction data in a portable format.
  • Delete your account and all associated data.
  • Opt out of non-essential communications at any time.

8. Security

We take security seriously. Agent Octane uses:

  • HTTPS encryption for all data in transit
  • Encrypted storage for sensitive fields
  • Access controls limiting which team members can view data
  • Regular security reviews

No system is 100% secure. If you suspect a security issue, please contact us immediately at support@agentoctaneapp.com.

9. Children's Privacy

Agent Octane is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If we discover that a child has provided us with personal data, we will delete it promptly.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we'll update the effective date and notify you by email if the changes are material. Your continued use of the Service after changes are posted constitutes acceptance.
